Participate.Energy (‘PE’, ‘we’, ‘us’, or ‘our’) is committed to protecting your personal information and ensuring appropriate protection exists when collecting, storing, using and reporting that information.
Scope
This Privacy Policy applies to all users and customers of PE within the United States, except where state-specific privacy law requires additional disclosures. Notice of Accessing, Collecting, Storing, Using, and Disclosing Energy Usage Information
PE, its employees, agents, contractors, and affiliates shall maintain the confidentiality of individual customer’s names, property addresses, telephone numbers, email addresses, account identifiers, billing amounts, and energy consumption information, except where reasonably necessary to conduct PE’s business, to develop offers or provide services to customers as required by applicable laws, regulations, or collaboration agreements with utilities or energy program administrators.
Examples of reasonably necessary business purposes include but are not limited to: (a) comply with law, regulation, or court order; (b) enable PE to provide services to its customers; (c) collect unpaid bills; (d) resolve customer disputes or inquiries; (e) communicate about demand response, energy efficiency, energy management, and conservation programs, or (f) in situations of imminent threat to life or property. PE shall not, under any circumstances, disclose customer information for third-party telemarketing, e-mail, or direct mail solicitation. Aggregated data that cannot be traced to specific customers may be released at PE’s discretion.
Collection and Use of Customer Data
Customer data, including individual customer names, property addresses, telephone numbers, email addresses, account identifiers, billing amounts, and energy consumption information, may be collected via our websites, UtilityAPI App, or solar energy system manufacturer (such as Tesla)’s software application. In certain cases, PE may collect information regarding home characteristics, product performance data, and diagnostic logs for solar energy system products.
Third-Party Sharing
We may share customer data with service providers, California Community Choice Aggregators (CCAs), governmental agencies, financing partners, contractors and vendors where reasonably necessary to operate programs, fulfill contracts, or comply with law. These third-parties are required to agree to only use customer data for program operational purposes and protect it under the same standards as PE. We do not sell personal information. We do not knowingly collect or sell personal information from individuals under the age of 18.
Retention
PE retains customer-specific energy usage and billing information only as long as is reasonably necessary to fulfill the purposes described herein, comply with legal obligations, or resolve disputes.
User Rights and Access
Customers may contact us regarding the collection, storage, use, or disclosure of information, or to request access, correction, or deletion of their personal data.
