  1. Overview

This California Privacy Notice supplements the information contained in the general Privacy Policy of Participate Energy (“PE,” “we,” “us,” or “our”) and applies solely to individuals who reside in the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and related regulations (collectively, the “California Privacy Laws”).

  1. Categories of Personal Information Collected

We collect the following categories of personal information from customers, website visitors, and users of our energy programs and services:

PE may collect the following categories of personal information via our website, the solar energy system manufacturer’s (such as Tesla Energy) App, or the UtilityAPI App: customers’ names, property addresses, telephone numbers, email addresses, electricity bill amount, and electricity consumption. If you enter a contest or sweepstakes offered by PE, we may collect any of the foregoing categories of personal information, as well as your photo/image and any other personal information you may volunteer.  In certain circumstances involving the purchase, installation or use of energy products, PE may also collect the following personal information: details regarding your home in connection with energy product installations; data regarding the performance, usage, operation, battery efficiency, and condition of your energy products; and diagnostic logs for your energy products. If you request our services in connection with applying for rebates under a Self-Generation Incentive Program (SGIP), we may collect any of the following categories of personal information: your first and last name; your address; your Social Security Number; your income; your utility usage; your utility meter ID; your utility service account information; your email address; and your phone number.

We do not knowingly collect or sell personal information from individuals under the age of 18.

  1. Purposes for Collection and Use

We use your personal information to:

  • to provide you with services that you request from us;
  • to fulfill obligations under a contract with you;
  • to resolve customer inquiries or disputes;
  • to communicate with you and business partners about demand response, energy efficiency, energy management, and conservation programs;
  • to communicate PE news and updates;
  • to promote sweepstakes and contests; and
  • to comply with applicable laws, regulations or court orders.
  1. Categories of Third Parties With Whom We Share Information

We may share your personal information with:

  • Service providers and contractors (e.g., installers, maintenance providers, billing processors).
  • Utility companies (for grid interconnection, net metering, or incentive programs).
  • Program administrators and governmental agencies (e.g., CPUC, energy rebate programs).
  • Business partners and affiliates (in support of joint marketing, financing, or customer service initiatives).
  • Legal or regulatory authorities as required by law.

We do not “sell” personal information as that term is defined under California law. However, we may engage in “sharing” for cross-context behavioral advertising, which you can opt out of at any time (see Section 7 below).

PE, its employees, agents, contractors, and affiliates shall maintain the confidentiality of personal information, except where reasonably necessary to conduct PE’s business, to develop offers, or to provide services to customers as required by collaboration agreements with California Community Choice Aggregators. Examples of reasonably necessary business purposes include but are not limited to when such disclosure is necessary to:

  • Comply with law, regulation, or court orders;
  • Enable PE to provide services to its customers;
  • Resolve customer disputes or inquiries;
  • Communicate about demand response, energy efficiency, energy management, and conservation programs; or
  • Situations of imminent threat to life or property.

Except as permitted by applicable law, PE shall not disclose customer information for third-party telemarketing, email, or direct mail solicitation. Aggregated data and anonymized data that cannot be traced to specific customers may be released at PE’s discretion.

PE may disclose your personal information to contractors and suppliers for purposes of providing services and operating programs. Contractors and suppliers are required to agree to only use customer personal information for program operational purposes and protect it under the same standards as PE (or at least with a reasonable degree of care).

For some of PE’s offerings relating to Tesla products, PE may disclose your personal information to Tesla, Inc., or one of its affiliates (collectively, “Tesla”); in such cases, the processing and use of such personal information may be subject to Tesla’s Privacy Policy (available at https://www.tesla.com/legal/privacy).  

PE maintains customer-specific energy usage and billing information for only as long as is reasonably necessary, typically not more than five years unless otherwise required by law or regulation.

  1. Tracking

Do Not Track Signals

Participate Energy does not respond to Do Not Track (DNT) signals from web browsers. However, we do not track users’ activities across other websites or online services.

Third-Party Tracking

We do not allow third parties to collect personally identifiable information about an individual user’s online activities over time and across different websites when the user visits our website.

  1. Data Retention

We retain your personal information only as long as necessary to fulfill the purposes described in this notice, comply with legal obligations, or resolve disputes.

California residents have the right to:

  • Access the personal information we have collected about you.
  • Correct inaccurate information.
  • Delete your personal information, subject to certain exceptions.
  • Opt-out of sale or sharing of your personal information.
  • Limit use and disclosure of sensitive personal information.
  • Non-discrimination for exercising your privacy rights.

Before fulfilling your request, we may verify your identity using the information you have provided to us, such as name, address, or service account details.

Authorized agents may submit requests on your behalf by providing proof of authorization.

  1. Updates to This Notice

We may update this notice periodically. The effective date for this version of the policy is November 7th, 2025. Any changes to this policy between notification periods will be communicated through PE’s website.
